General conditions of sale (G.C.S.)

Minors and legal capacity

Order n° 59-107 of 7 January 1959, law n°74-631 of 5 July 1974 and article L.3353-3 of the Code of public health prohibit the sale of alcohol to minors. Any customer ordering wine or champagne from NECTAR DES DIEUX must consequently be over 18 on the date of placing the order.

Alcohol abuse

Alcohol abuse is dangerous to health so drink it in moderation.

Introduction

The company NECTAR DES DIEUX (the Vendor) is responsible for the on-line development and distribution of champagne. These general conditions of sale govern sales made by NECTAR DES DIEUX from its internet site www.champagnevirginiet.com and exclude any other conditions.

Article 1 – Field of Application of the general conditions of sale and amendments

These general conditions of sale apply to all orders placed on the internet site www.champagnevirginiet.com.

NECTAR DES DIEUX reserves the right to change these general conditions of sale at any time. If they are altered, the general conditions of sale in force on the date of placing the order shall be applied for each order. The G.C.S. in force are those whose date is shown at the top of these G.C.S. and on the order confirmation slip.

Article 2 – Acceptance of these general conditions of sale

When a Customer confirms his order on the www.champagnevirginiet.com website (by clicking on the button: I declare that I am legally old enough to purchase alcohol, that I have read through the general conditions of sale and accept them in their entirety) this is equivalent to the full and entire acceptance of these general conditions of sale as a whole and without reservation, and these G.C.S. apply to the exclusion of any other document.

In particular, the Customer is confirming that he is legally old enough to purchase and consume alcohol in the country where his order will be delivered at the time he places this order and that he is aware that as alcohol abuse is dangerous to the health, it must be consumed in moderation.

Article 3 – Taking the order

Placing an order involves a certain number of stages which the Customer must then confirm:

-        Being aware of these G.C.S. and the legal conditions

-        Creation of a member account or confirmation of his username and password in the case of an existing member

-       Choice of products, of their essential characteristics, acceptance of their price

-        Confirmation of the billing and delivery addresses

-        Confirmation of the final computerized order form, including the Price of products, price of transport, and applicable taxes

-        Choice of a method of payment available on the list of payment options, and entry of the data needed for the payment

-        Confirmation of payment

The information provided by the Customer, when placing the order, are binding: If there is any error in the recipient’s details, the vendor cannot be held responsible for any delays or for the impossibility of delivering the product. Orders are only definitive when confirmed by means of the purchaser paying the price with subsequent approval from our Sales department.

All offers are understood to depend on the stock available.

At the moment products purchased on the www.champagnevirginiet.com website can only be delivered to the countries indicated, apart from the exceptions indicated per post code under delivery information (DOM-TOM, Corsica, Isle of Wight, etc.)

 

Article 4 – Offer & Availability of Products

Offers are always made subject to the quantities available. 
If the Products ordered are unavailable and the order is cancelled after it is placed, the price shall be repaid to the Customer within one (1) week.

Article 5 – Acceptance of the order

The order is accepted when NECTAR DES DIEUX has collected the payment and has received all the elements needed for satisfactory contractual performance. The term “elements” refers to the following:

-           placing the order on the www.champagnevirginiet.com website

-           exact billing addresses, contact name and telephone details;

-           exact delivery addresses, door code, and telephone details of recipients. These addresses and telephone details must be checked, updated and confirmed by the Customer.

If the information sent through proves incorrect, obliging NECTAR DES DIEUX to return the orders to the warehouse, the Customer shall bear the consequences of this and NECTAR DES DIEUX shall be entitled to bill the administrative and transport costs associated with returning the orders, namely: 15 Euros ex-VAT per cardboard box of 1 or 6 bottles.

Orders can only be accepted if accompanied by payment of the whole of the price, inclusive of tax and shipping fees. If NECTAR DES DIEUX fails to receive the payment ten (10) days at the latest after the order, it is automatically cancelled.

Article 6 – Price

Our sales prices indicated on the www.champagnevirginiet.com internet site when the order is placed are stated in Euros or Pounds Sterling and are understood to include all taxes, but to exclude shipping costs, unless there is any obvious error.

A detailed table of shipping charges is provided under the section “Delivery and Services” on the website.

The total amount indicated by NECTAR DES DIEUX at the end of the order is the definitive price comprising: the products, handling and packing costs, participation in the costs of the delivery service chosen and taxes and excise duty in force in the country where the delivery is to be made.

Article 7 – Conditions of payment & Method of payment

Full payment for the items must be made to NECTAR DES DIEUX to cover the entire order.

Payments are made by secure payment via the "OGONE" secure system which allows bank details to be encrypted during secure transmission on the network.

Other methods of payment can sometimes be offered in certain countries.

 

Article 8 – Reservation of ownership

The transfer of ownership of Products to the Customer takes place when the whole of the order price has been paid, with NECTAR DES DIEUX reserving the right to take back possession of the Products if the whole of the price is not paid.

 

Article 9 - Delivery, delivery deadline, receipt

Virginie T. champagne is mainly delivered in boxes of 1, 3 or 6 bottles. Some references may not be offered for sale in certain areas, depending on the country and the post code (ZIP CODE) The boxes are sometimes grouped together in packages of 2 boxes. Packages from the same order sometimes involve more than one delivery (rare).

NECTAR DES DIEUX undertakes to do its utmost to deliver products as quickly as possible using the service selected whenever there is a choice. Delivery times may vary according to product availability, and the type of transport chosen. Delivery takes place within the time indicated either by sending the product directly to the recipient, or if he is absent, by leaving a non-delivery notice. Products may also be sent to the recipient in shops offering an agency service, against a signature.

Delays do not give the Customer the right to cancel the sale, to refuse the merchandise or to make a claim for damages. Delivery times are calculated from the first working day (excluding week-ends and public holidays) after receiving payment, authorisation from the bank and acceptance from the sales department.

In the event of breakage duly noted on receipt, NECTAR DES DIEUX shall do its utmost to replace the broken Product or Products as quickly as possible. The Customer cannot ask for his order to be reimbursed unless it is not possible for NECTAR DES DIEUX to re-deliver the products.

The Customer is responsible for checking the contents of the package or packages when they are delivered and for accepting or refusing all or part of the order. Refusal of all or part of the order must be notified and signed for on the delivery note supplied by the carrier or by immediately calling the carrier’s customer service, in the presence of the delivery operator.

Article 10 – Force Majeure

The following are considered to be cases of force majeure relieving the vendor of his obligation to deliver: war, riots, fire, strikes, traffic bans, accidents and the impossibility of obtaining supplies.

Article 11 – Right of cancellation

In application of article L. 121-17 of the Consumer Code, the Customer has a period of fourteen (14) clear days following delivery of his order to exercise his cancellation rights and to send back the product. The product must be returned in good condition and in its original packaging accompanied by the original invoice that the Customer has received by mail, requesting either exchange or reimbursement. If some products have been opened or consumed, these products shall be deducted from the reimbursement made to the Customer. Return costs will be the responsibility of the Customer.

The customer must inform the NECTAR DES DIEUX Customer Service by email of its decision, directly contacting: clients@champagnevirginiet.com (or by going to our website www.champagnevirginiet.com: contact us) and wait for confirmation from NECTAR DES DIEUX together with the return address prior to returning the merchandise. The products shall be returned by the carrier chosen by the Customer.

On the other hand, if the customer notes a problem for which NECTAR DES DIEUX is responsible (for example: the products which are delivered are not the same as those ordered), NECTAR DES DIEUX undertakes to reimburse all the costs incurred by the customer: price of the product plus return costs, and dispatch costs, provided the products are returned as they are found.

Article 12 – Competent jurisdiction

These general conditions of sale are governed by French law. Contractual information is provided in the French language and the products offered for sale comply with the legislation of the countries in which the goods are delivered.

These general conditions therefore apply in the case of a contract concluded by a consumer placing an order from another country in the European Union. Any dispute arising in relation to fulfilling or interpreting this type of contract shall go before the competent jurisdictions by virtue of the directives and agreements of the European Union (in particular the Brussels Convention, 27 September 1968).

If necessary, a foreign Customer is responsible for checking with local authorities on the possibility of using the product he intends to order. NECTAR DES DIEUX shall not be responsible in the event of failure to comply with the regulations on consuming the product in a foreign country where the product is delivered. The country in the place where NECTAR DES DIEUX has its registered office is alone competent to deal with any dispute arising from applying these general conditions of sale excluding any referral by NECTAR DES DIEUX to another competent jurisdiction.
